Comment: Why wasn't there any awareness made available for the allottees when this Oil leasing was started. There is a lot of flipping and some people got a lot less than others. There is a lot of wrongdoing with the leases like the superintendent signing over leases and companies assigning leases to other companies like Dakota 3. People signed leases for the same land and people didn't even know what they were signing. The story about grandma signing without any knowledge about what she signed is common. |

If you're getting oil money, ask Minerals Management Services (MMS) if ALL the production is being sold and WHO all is getting paid from your minerals. |

Comment: Dawes Act of 1887 devastated the Native American in many ways. It's purpose was to "assimilate" Natives AND open Indian land to land-hungry white homesteaders! It reduced 138 million acres of Indian land to 20 million, of which was mostly semi-desert or unfit for profitable uses! Those Natives fortunate enough to have farming/grazing land, lacked the resources and help to flourish those pursuits and were forced to lease land to non-Natives. The Mandan, Hidatsa, Arikara are living proof of this! |

Comment: Richard, I agree in some ways about signature endorsement. However; Keep this in mind. Remember back at the beginning of the Garrison Diversion Project.... They were moving dirt and building the Garrison Dam before Chairman Gillette even signed those papers! In short they would have pulled the same kinda of crap with the oil. Putting up wells only in border towns and purchasing up deeded land and mineral rights on the sly. Snakes!!Question is where are we going from here? Save the tribe or just pad a few greedy bank accounts? |

As the Lessor, you are NOT negatively affected by the assignment from the original Lessee to a different party. Comment: Also, if you signed an OGL as Lessor, and then you passed away while the OGL was still in effect, an ASSIGNEMENT would be executed, legally transferring your interest to your heirs or designees. Basically both the Lessor and Lessee are allowed to assign their interest in any OGL to anyone, at any time. However, the terms of the lease (and any obligations or requirements stipulated in the lease) are not affected by assignment, and all assignees must abide by those terms. Make sense? |

The state gets TWICE as much revenue from WITHIN FB boundaries as the TBC. Levings INDEFINITELY extended this tax agreemt last year, Jan 2010, probably with the support of the rest of TBC. With $100 million tribal govt debt, how did TBC spend the $19 MILLION tax dollars they rec'd from this tax agreemt? |

Some rural resident still did NOT have water on Saturday. Heard the water pipeline breakdowns were from north of Mandaree by Blue Buttes, Mandaree school, Skunk Bay, and east of Mandaree. Leaking? Drinking water exposed to contamination? Valves broken? Unknown. There's been many breaks in the Mandaree water system in the past couple of yrs. |

No info on how much we will be charged. Also they were going to start to bill "the industry" for water. Comment: Word is some tribal membrs have to resort to their own ways to increase SAFETY on FB rez roads. Trying to get oil trucks to slow down reportedly ended in a trucker pulling a gun on an unarmed tribal membr. So, some TER0-approved trucksters carry weapons. There are officers trying to do their jobs. But for an immature tribl govt, 638 allows both political interference & indifference to law enforcmt. After all, we're sovereign. The end result? Tribal membrs take law enforcmt into their own hands. |

Comment: Today's Minot Daily 8/28/11 article, "Bear Den Oil Spill," Last months's oil spill is still contaminating the Bear Den Creek in Mandaree because of oil well pump seal failure. Poor quality of equipment from a TERO vendor? Poor workmanship? Lack of monitoring? Carelessness? All unknown. The unidentified TERO-approved oil company is still TRYING to prevent the contamination from reaching Lake Sakakawea. The Mandaree water system is nearby and downstream from this spill. |

Sounds like the truck driver is from Thailand (Asia) tipped over the truck by a creek that goes into Lake Sakakawea, our drinking water. BARRELS of toxic 'salt water' spill not known. Comment: It sounds like that truck spill south of Parshall yesterday was caused by Beaver Creek and spilled saltwater or fract water on land and into a small creek that goes to the lake. Towns downstream, maybe White Shield also, might be drinking this soon. Salt water kills the soil so you can't grow crops anymore. Any animals,cows, horses, wildlife, migrating birds could also be drinking from this creek also. It's a tribal oil company that caused damage so is the tribe going to fine them? How much? |

Comment: The BIA receives about 800 dollars per truck each day. In a month they receive estimated 120,000. That is for wear and tear, where does the money go? Some companies make three million for a job. Dakota 3 sells 104 thousand dollars of oil per month. The non potable water, which no one is allowed to wash even their hands with is spill everywhere. |

Comment: Part of Hwy 23 by Parshall blocked most of Sept 29 because of hazardous chemical spill by oil truck. Hwy 37 also closed. The truck driver turned fast. Both truck and trailer tipped over. Report all the FB spills you know about on this page. We need a public record of the "known" spills & other damages caused by carelessness or deliberately. This will not include the other spills and damages that go unreported and unmonitored on Ft Berthold. |

A break in TransCanada's high-pressured 30-inch Bison Gas Pipeline spewed a brown cloud in July 2011 in Wy. Its now 15 weeks later & TransCanada (tar sands) STILL DOESN'T KNOW what caused its own pipeline explosion. 15 weeks later, their spokesman is quoted as saying,"We aren't, at this time, certain as to what happened when." |

Comment: 2 Oklahoma men are charged in federal court with terrorizing tribal members traveling on the highway west of New Town last month. The 2 men pulled along side of the tribal members on the highway and threatened them, pointing a gun at the tribal members. A shotgun and a pistol were confiscated from the two men. Comment: The EPA found high levels of methane, benzene, in 2 more Wyoming drinking water wells near fracking zone. 17 water wells also tested last year had FIFTY times the EPA level for cancer-causing benzene. Last yr, residents were told to VENTILATE their bathrooms while showing & NOT DRINK THE WATER from the contaminated wells, & NOT USE THE WATER FOR COOKING. These huge mounds of trash were in an oil well area fenced off for Williams oil well & road closed to the public. Mandaree residents CARE about the land. This Williams Oil is the SAME oil well which carelessly burned over 70 acres of allotte lands in May. Tribal homes were in the path of the Williams-caused prarie fire. Local car/pickup was FORCED into wrong lane & trucker kept going. Another TERO-approved trucker endangering lives. Comment: Few tribal members know that while the State of ND has been TAXING allottee minerals - the State of ND has exempted all the fee land minerals from taxation, inside the Ft Berthold boundaries - for years. Only tribal minerals are taxed by ND. Oil from fee lands on FB has NOT - is not - taxed by the State of ND. The TBC agreed to this, knew about it, and STILL signed the State-TAT tax agreement. Not only that, ML also renewed this ND-TAT oil and gas tax agreement "indefinitely." |
